These Terms of Service ("Terms") govern access to and use of the e-commerce platform (website/app) operated by Bhima Jewellery Madurai, having its registered office at 137, West Masi Street, Madurai, Tamil Nadu, 625001, India (GSTIN: 33AAIFB1068K1ZJ) (hereinafter referred to as "Bhima Jewellery," "we," "us," or "our"). By accessing or using the platform, placing an order, or creating an account, the user ("you," "customer") agrees to be bound by these Terms.

The platform may only be used by individuals who are 21 years of age or older and are competent to enter into a legally binding contract under the Indian Contract Act, 1872. By using the platform or placing an order, you represent and warrant that you meet this eligibility requirement. Bhima Jewellery reserves the right to refuse service, cancel orders, or terminate accounts where this requirement is not met.

To place an order, you may be required to register an account using accurate, current, and complete information, including a valid email address and phone number. You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account. Bhima Jewellery is not liable for any loss arising from unauthorized use of your account due to your failure to safeguard your credentials.

All products listed on the platform are subject to availability. Product images are for representational purposes; actual products may show minor variations in color, finish, or appearance due to photographic and screen display limitations, lighting, or natural variation in handcrafted pieces. Pricing, rate determination, and order confirmation are governed by the Pricing Policy and Payment Policy, which form part of these Terms by reference.

All orders must be paid for in full at the time of checkout. The platform operates on a prepaid basis only; Cash on Delivery is not available. Payment terms, accepted modes, and refund mechanics are governed by the Payment Policy.

Shipping, delivery timelines, identity verification at delivery, and related terms are governed by the Shipping & Delivery Policy. Risk in the product passes to the customer upon delivery confirmation as described therein.

Order cancellations, returns, and refunds are governed by the Order Cancellation Policy and the Return & Refund Policy respectively. Customers are required to comply with the mandatory unboxing video and evidence requirements under the Packaging & Tamper-Evidence Policy in order to be eligible for any claim relating to damage, discrepancy, or defect.

You agree not to:

Use the platform for any unlawful purpose or in violation of these Terms

Attempt to gain unauthorized access to the platform, other user accounts, or Bhima Jewellery's systems

Engage in fraudulent transactions, including providing false identity, payment, or KYC information

Use any automated means (bots, scrapers) to access or extract data from the platform

Upload or transmit any content that is unlawful, defamatory, obscene, or infringes third-party rights

Bhima Jewellery reserves the right to suspend or terminate accounts and cancel orders associated with any violation of this clause.

All content on the platform, including but not limited to the Bhima Jewellery name, logo, trademarks, product designs, images, text, and software, is the exclusive property of Bhima Jewellery or its licensors and is protected under applicable intellectual property laws. No content may be reproduced, copied, distributed, or used for any commercial purpose without prior written consent from Bhima Jewellery.

The platform may integrate or link to third-party services, including payment gateways, logistics partners, and financing/EMI providers. Bhima Jewellery is not responsible for the acts, omissions, terms, or policies of such third parties, which are governed by their own respective terms.

The platform is provided on an "as is" and "as available" basis. While Bhima Jewellery takes reasonable steps to ensure accuracy of product, pricing, and availability information, we do not warrant that the platform will be uninterrupted, error-free, or free from inaccuracies, and reserve the right to correct any errors, inaccuracies, or omissions at any time, including after an order has been placed, per the Pricing Policy.

To the maximum extent permitted by applicable law, Bhima Jewellery's aggregate liability arising out of or relating to any order shall not exceed the amount paid by the customer for that specific order. Bhima Jewellery shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of the platform or any product purchased through it, except in cases of proven manufacturing defect or willful misconduct.

You agree to indemnify and hold harmless Bhima Jewellery, its directors, employees, and agents from any claims, damages, liabilities, and expenses arising out of your breach of these Terms, your misuse of the platform, or violation of applicable law.

In accordance with the Consumer Protection (E-Commerce) Rules, 2020 and applicable Information Technology rules, grievances or complaints regarding the platform may be addressed to the Grievance Officer:

Grievances will be acknowledged and resolved within the timelines prescribed under applicable law.

Bhima Jewellery reserves the right to modify, update, or amend these Terms, and any of the policies referenced herein, at any time without prior notice, as determined by Bhima Jewellery from time to time. Continued use of the platform after such changes constitutes acceptance of the updated Terms. Customers are encouraged to review these Terms periodically.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

These Terms shall be governed by and construed in accordance with the laws of India. Subject to the dispute resolution mechanisms (if any) under applicable consumer protection law, any disputes arising out of or in connection with these Terms or any order shall be subject to the exclusive jurisdiction of the courts at Madurai, Tamil Nadu.
